What is the purpose of a Facebook page for CAPTALK? I am not sure I can see any added value to the CT web-site, just more confusion...

I love how people believe that Free Speech means I can do anything I want with other peoples ideas.  Free speech applies to speaking out against the government.  Not taking someone elses property (CAPTalk symbols and names) and creating your own site.

I may just start a page called California Highway Patrol and use their badge as my homepage.  Free speech.

While taking the header from this page is wrong, anyone can create a fan page for anything. It just means they like it.

They only violated #1. So at best they can have FB take the image down but they can't have the page scrubbed.

Actually no they can't. They can only control this website. What someone says in another venue is not under CT's control.

In the same way CAP could control its image if it so chose.

"Fan" sites, provided they are not deceptive or trying to impersonate the item that they are fans of, do not violate trademarks for instance.

Just a basic primer of trademark.  It's all about deceptive content.

I could go and create a captalk.org, and for example, have a site that's all about my love of baseball caps.  Captalk.net would not have any trademark infringement case against me whatsoever, as no reasonable person would confuse the content.

Fan sites fall into much the same category, along with things like anti-fan sites...think of sites like http://www.walmartsucks.org/

Free speech prevents government action from censoring speech.   

For example if you come onto my property, I'm completely free to tell you to shut up, and you have no free-speech right to tell me to pound sand.  However, if you refuse, my only remedy is to uninvite you from my property, and if you refuse to leave, have you arrested for trespass.  You would be arrested for being on my property without permission, not for mouthing off.

In the instant case, the operators of captalk.net are completely free to ban someone for creating something that they disagree with.  They, however, have no right to demand that a third-party, ie. Facebook, take some action based on their displeasure.

It depends what you say, some forms of speech these days are actually characterized as assault (such is the world we live in).

As to a "Fan Page" where the person or thing so loved says "knock it off", one would think if you actually respected the person or thing, you would.

(heh, I "liked" the "official" one, just so that JC004 has no idea what I'm up to now!)
That is the one and only thing I have ever liked, and ever will.

I don't even know - I don't use it.  I've got a G+ and Twitter accounts, too.  Same deal.
In fact I probably have live accounts on every major "social" service.

I have to be informed on the tech and the platforms to support clients, but I have no use for them.

To be clear, I only asked him to delete the "fan page".  Mainly because it was lame.  But also because it was a first post and seemed very suspicious.  Later proved to be a duplicate account of a forum user, which is a no-no.  I didn't ban him, a moderator did in the course of their duties here.
