Title: Local MOU

Does anyone have a copy of a local MOU between a squadron and local EM agency that meets all of the criteria set forth in the 16NOV07 ICL?

I am trying to put together such an animal and hate to try to reinvent the wheel

Have your Wing Legal Officer call NHQ General Counsel office and get the most recent copy emailed to you.

Also, the state director is supposed to be involved in MOU's.

You didn't mention what the MOU was for exactly, but if it is ES-mission related, you might want to review the MOU that should be in place between your state and CAP as it might not be necessary or it may govern how local requests are made.  For example, the state MOU might require that all requests from county governments to CAP go through the state emergency mgt agency.

Before you put too much effort into it, I agree with KyCAP -- get with the legal folks first. And remember that any MOU has to be signed by the wing commander.

I have been working on a similar issue with my local EMA.  The process that I would suggest from personal experience is this.

Get with your Wing Ops and ES folks, ensure they know that you are talking with these agencies, and make sure that they have direct input into what you "sell" to the ema. 

After you are satisfied that the EMA is VERY clear on your LOCAL capabilities, and the time table for calling in additional resources, and the fact that CAP as a resource is hands off if there is even a hint of criminal activity, as well as the fact that the preferred method for activating CAP is to request us as a federal asset (through AFRCC), and secondarily through the NOC.

THEN, you can proceed to work out additional details, this means figuring out what types of missions we will help the EMA with (Air, Ground, DR) and our requirements for personnel at mission base, and our integration of paperwork, and let them know that we are by and large self funded so when they plan for food, water and housing to include us into those preparations.

Finally, once everyone is clearly aware of the others capabilities then you should proceed with MOU's, there is a lot of foot work to be done before even bringing up the idea of having joint operations.  Because the first time we oversell and don't deliver the EMA will cut the cord and just stop calling.

The other thing I forgot to mention.

As a semi-solid rule EMA's will cover members <OVER> the age of 18 under their insurance.  They will not usually make exceptions for members under 18.

What this amounts to is that if you try to get an MOU approved you will be eliminating the ability of our under 18 members to participate in these missions because MOU mission are not covered under Federal insurance.

You are much better off to work with your wing staff to create a set of operating procedures and not getting a formal MOU, you will be much more free in your actions that way.

I think your add on is something very particular to your local area.  Never heard of a county covering CAP under their rules for those issues, though it is done in some states.

Being covered by ema may very well be local.

Not being covered federally is not, and that is the point I was trying to make
