Title: Volunteer Protection Act of 1997 Affects CAP Members?

It's interesting but in no level 1, 2, 3 CAP professional training programs does this act ever get discussed and it's potential positive impact on Civil Air Patrol senior members as far as liability issues.

Prior to finding this reference on the Sea Cadet Corps website for recruiting adult members http://www.seacadets.org/public/officer/trifold-faq-officer-low.pdf (http://www.seacadets.org/public/officer/trifold-faq-officer-low.pdf)  I was not aware of its' existence.

That said, if my boss wasn't kosher with my leaving for something, I wouldn't go. I'm not going to throw an employment law in her face. Even though the law "protects" me from retaliation, I really don't feel like burning up all of her goodwill towards me for CAP's sake.

The law RM cited is for liability coverage. It has nothing to do with leave and employment protection.

If we are on an Air Force authorized mission we are covered by the Federal Tort Claims Act and the Volunteer Protection Act of 1997 would be moot.  CAP purchases general, aircraft, and vehicle liability insurance for times when we are on official CAP business, so we are not bereft of insurance like some organizations with not so deep pockets seem to be.  I'm sure the insurance company lawyers would be standing by to invoke the Volunteer Protection Act of 1997 to limit their liability in a case involving CAP corporate liability.  I'm not too concerned about it - read CAPR 900-5 and think about it in conjunction with the law you cite.

Doesn't seem to cover anyone driving or flying a plane anyway.
